Description
Amendment 10 - Background:
Amendment 10 does not require a response or acknowledgement from offerors, but these submission instructions provide the following clarification regarding the required offeror response to Amendment 9.
The FAA issued Amendment 9 to the FENS SIR on April 5, 2022. The submission instructions issued with Amendment 9 identified two response deadlines:
April 12, 2022: Provide the FENS Contracting Officer (CO) with an assessment of whether any of the changes to the FENS SIR in Amendment 9 require proposal changes
April 19, 2022: Provide the FENS CO with the values for two linear multiplier factors and a letter signed by an authorized corporate official to extent the validity period of the offer to March 31, 2023
On April 12, 2022, the FENS CO notified each offeror via e-mail that Amendment 9 response deadline was extended to May 10, 2022 and that the FAA would be issuing an amendment to remove AMS clause 3.2.2.3-38 (Requirements for Certified Cost or Pricing Data or Data Other Than Certified Cost or Pricing Data) from SIR Section L.2.
Submission Instructions:
Amendment 10 does not require a response or acknowledgement from offerors, but these submission instructions provide the following clarification regarding the required offeror response to Amendment 9:
Amendment 9 included updates to three AMS clauses in Section K (Representations and Instructions):
3.2.5-7 Disclosure Regarding Payments to Influence Certain Federal Transactions (January 2022)
3.2.2.7-7 Certification Regarding Responsibility Matters (October 2021)
3.2.3-1 Cost Accounting Standards Notices and Certification (January 2022)
With the response to Amendment 9 that is due no later than 5:00pm Eastern Time on May 10, 2022, each offeror is required to include an explicit statement in its signed letter of transmittal whether any updates to its representations and certifications originally submitted within Proposal Volume V (Miscellaneous) are needed as a result of the updates to the three AMS clauses listed above. Offerors that need to make updates to their representations and certifications as a result of the updates to the three AMS clauses listed above must submit them to the FENS Contracting Officer at 9-ajw-fensinfo@faa.gov as an update to Proposal Volume V (Miscellaneous) with tracked changes visible no later than 5:00pm Eastern Time on May 10, 2022.
