Description

NOTICE OF INTENT TO SOLE SOURCE – Modification: Increase quantities for required metal repairs on the five (5) remaining Tainter Gates under contract W9127S20C0008.

This notice is being published in accordance with DFARS PGI 206-302-1, which states, “when utilizing the authority at FAR 6.302-1, the contracting officer shall post a request for information or a sources sought notice and shall include the results of this inquiry in the justification required by FAR 6.303.” The statutory authority for this notice of intent to sole source modification is 10 U.S.C. 3204(a)(1) as implemented by FAR 6.302-1(a)(2), Only One Responsible Source and no other services will satisfy agency requirements.

The U.S. Army Corps of Engineers, Little Rock District (SWL), intends to issue a Firm-Fixed Price (FFP) modification to contract W9127S20C0008 to increase quantities for required metal repairs on the five (5) remaining Tainter gates in the contract. Wilbur D. Mills Dam has not been rehabilitated since the 1990s and funding constraints have limited routine maintenance over the years, thus generating a need for extensive structural repairs that the contractor and Government are discovering together on this contract. These repairs differ from gate to gate and cannot be quantified until the gates are stop-logged and placed out of service for pre and post sand blasting inspections.

In March 2024, an SWL structural engineer completed inspections that revealed significant damage to two (2) of the remaining Tainter gates. These, along with pre-determined damages found on the other gates, solidified the conclusion that modifying the current contract to increase metal repair quantities is critical to the stability and longevity of the Tainter gates. If these repairs are not completed swiftly, there is potential for gate failure, which will have a damaging impact to navigation on the McClellan-Kerr Arkansas River Navigation System (MKARNS). Dam failure is also a major risk, as there is a potential threat to downstream property and livelihood.

*This is not a solicitation for competitive proposals; however, if any interested party believes that they can meet the above requirement, they may submit a capability statement to the point of contact listed in this Special Notice. All information furnished must be in writing and must contain sufficient detail to allow SWL to be able to determine if the interested party can provide the requirement described herein.

All responsible sources may submit a capability statement which shall be considered by the agency. The submission must be received no later than 12:00 PM CDT on July 1, 2024.
