Description

This is not a solicitation announcement.  This is a sources sought synopsis only.  The purpose of this sources sought synopsis is to gain knowledge of potential qualified small business sources and their size classifications (i.e., HUBZone 8(a), 8(a), HUBZone, Service-Disabled Veteran-owned, Veteran-Owned, Women-Owned Small Business, and Small Disadvantaged Business) relative to the North American Industry Classification System (NAICS) code 541612 (Human Resources Consulting, $25.5m).  Responses to this sources sought synopsis will be used by the Government to make appropriate determinations about potential sources.  Only small business sources shall respond to this sources sought notice. 

Project Title:  OCI – Human Resource Employment Consulting Services

Project Description: 

The Food & Drug Administration (FDA), Office of Criminal Investigations (OCI), is responsible for conducting and coordinating agency criminal investigations relating to violations of the Federal Food, Drug, and Cosmetic Act, Federal Anti-Tampering Act, Title 18 offenses and other areas over which FDA has jurisdiction. The special agents of the OCI are charged with investigating alleged criminal violations within FDA’s jurisdiction. These violations include counterfeit, unapproved and illegal drugs or medical devices; product substitution; health fraud and health care fraud and application fraud among other violations.

The FDA requires consulting services to FDA/Office of Regulatory Affairs (ORA)/OCI in the areas of employee relations advisory services and case processing, conflict resolution, mediation, grievance processing, review of personnel misconduct investigations, policy and procedure development relating to employment, as well as other human resources matters involving law enforcement personnel issues. The consulting services directly involve law enforcement personnel who are in rigorous positions which are subject to medical standards and physical requirements approved by the Office of Personnel Management and are authorized to carry weapons as well as other employees of the FDA/ORA/OCI who are not law enforcement officers.

Scope: See attached Draft Statement of Work.

The scope of this acquisition is anticipated to include Human Resources (HR) consulting services for the following:

1.         Guidance to OCI management and administrative personnel involving employee relations and employment regulations, policies and procedures

2.         Trainings or presentations for OCI employees and supervisors regarding updated HR laws and regulations

3.         Misconduct investigations, grievance processing and mediation

4.         Program management support in administering the resulting contract

Your responses to the questions provided below will assist the Government in selecting the appropriate acquisition method.  Page limit: Maximum 10 pages (font size Times New Roman 11 or larger).  A copy of the company capability statement will also be accepted (but not in place of the responses to the below questions).  The anticipated period of performance is a 12-month based period, with four (4) 12-month option periods.  After review of the responses received, a pre-solicitation synopsis and formal solicitation may be published on SAM.gov.

Responses to this notice must include company name, address, point of contact, size of business pursuant to the NAICS code “541612 Human Resources Consulting Services, standard size $25.5m,” and must respond to the following questions:

  1. Is your business a small business under the NAICS code?
  2. Does your firm qualify as a small disadvantaged business?
  3. If disadvantaged, specify if your firm is certified under Section 8(a) of the Small Business Act?
  4. Are you considered a certified HUBZone firm?
  5. Are you considered woman-owned or operated business?
  6. Are you a certified Service-Disabled Veteran-Owned or Veteran-Owned business?
  7. Describe your proven capability to provide the tasks 4.1, 4.2, 4.3, 4.4, 4.5 and 4.6 as outline in the Draft Statement of Work (SOW), attached.
  8. Do you have an existing contract vehicle available that provides these services (GSA MAC or other GWAC available for potential FDA utilization)?

This is not a request for proposals and in no way obligates the Government to award any contract.  Responses to this notice shall be emailed to Nicholas.bisher@fda.hhs.gov and James.Whitt@fda.hhs.gov.  Telephone and mail responses will not be accepted.  Responses must be received via email, by no later than 3/17/2023, 3:30 PM EST. 

No solicitation is currently available.  Responses to this sources sought synopsis will not be considered adequate responses to the solicitation, a request to be added to a prospective offerors list, or a request to receive a copy of the solicitation.
