Description
On March 15th 2024, the Naval Air Systems Command (NAVAIR) at Patuxent River, MD awarded a Cost Only, Level of Effort (LOE) - Term delivery order to The Raytheon Company, Space and Airborne Systems (SAS), 2000 East El Segundo Blvd., El Segundo, California. The order provides engineering to support the execution and reporting of Developmental Test & Evaluation (DT&E) and Operational Testing (OT) efforts. The scope of this effort includes Aeromechanical Flight Testing, High Power Electronic Attack Technique Radiation Test Support, and Mission Systems Flight Testing to support Initial Operational Capabilities (IOC). This delivery order has been placed under Basic Ordering Agreement (BOA) N00019-20-G-0007.
The statutory authority permitting other than full and open competition is 10 U.S.C. § 2304(c)(1) as implemented by the Federal Acquisition Regulation (FAR) 6.302-1: "Only one responsible source and no other supplies or services will satisfy agency requirements," and more specifically 10 U.S.C. § 2304(d)(1)(B) as implemented by FAR 6.302-1(a)(2)(ii): "Supplies may be deemed to be available only from the original source in the case of a follow-on contract for the continued development or production of a major system or highly specialized equipment, including major components thereof, when it is likely that award to any other source would result in (A) Substantial duplication of cost to the Government that is not expected to be recovered in competition; or (B) Unacceptable delays in fulfilling the agency's requirements."
This was not a commercial buy; therefore, the Government did not use the provisions of FAR Part 12 for this acquisition. This synopsis is published for informational purposes only.
