Description
Army Contracting Command – Detroit Arsenal (ACC-DTA) intends to award a Firm-Fixed Price (FFP), sole source contract to WFEL Limited (WFEL), of Stockport Cheshire, United Kingdom, under solicitation W56HZV-21-R-0190. The proposed contract action is for an Engineering Change Proposal (ECP) to integrate a solution to prevent Dry Support Bridge (DSB) equipment damage during rail transport tests. This requirement consists of the development of a kit of parts for 46m loads after rail impact testing and updates to the TM with optional support to further update the TM to support verification. The Government intends to solicit and negotiate with only one source under the authority of Federal Acquisition Regulation (FAR) 6.302-1(a)(2), “Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.” Specifically, FAR 6.302-1(a)(2)(ii) states “Supplies may be deemed to be available only from the original source in the case of a follow-on contract for the continued development of production of a major system or highly specialized requirement, including major components thereof, when it’s likely that award to any other source would result in – (A) Substantial duplication of cost to the Government that is not expected to be recovered through competition.” FAR 6.302-1(a)(2)(iii) states “Services may be deemed to be available only from the original source in the case of follow-on contracts for the continued provision of highly specialized services when it is likely that award to any other source would result in - (A) Substantial duplication of cost to the Government that is not expected to be recovered through competition.” This is a notice of intent, not a request for competitive action, upon response to this notice, is solely within the discretion of the Government.
