Description

The Commodity Futures Trading Commission (CFTC) intends to award a sole source purchase order to RELX Inc. (RELX) for subscriptions to the following titles/contents of specific legal treatises: Administrative Law, Benders Federal Practice Forms, Collier on Bankruptcy, Corbin on Contracts, Federal Antitrust Law, Federal Litigation Guide, Moore’s Federal Practice, and Weinstein’s Federal Evidence. These titles are exclusive to RELX and are available in three formats: print, through the RELX database, or in e-book form through the RELX Digital Library. There are no known alternative sources where the CFTC can obtain the same or comparable information contained in the subject titles. 

The period of performance of the purchase order will be for a one (1) year period from September 7, 2022 through September 6, 2023.  This procurement action is being performed pursuant to FAR 13.106-1(b), Soliciting from a single source: (1) For purchases not exceeding the simplified acquisition threshold, (i) Contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization). The authority for permitting other than full and open competition is 41 U.S.C.3304(a)(1), as the services needed by CFTC are available from only one responsible source and no other type of services will satisfy the needs of the agency.

This notice does not constitute a solicitation for offers and, as such, no solicitation is available. However, the Government will consider responses from all responsible sources received by the response date and time identified in this synopsis.  Written responses must include sufficient information to establish capability to fulfill the requirement.  Any responses received will only be considered for the purpose of determining whether to conduct a competitive procurement in lieu of the sole source contract described in this notice, and such determination shall be made at the sole discretion of CFTC.
