This Notice of Intent is not a request for competitive proposals

 No solicitation documents are available

The United States Department of Agriculture (USDA)/Animal Plant Health Inspection Service (APHIS)/ Plant Protection and Quarantine  (PPQ)  Center for Plant Health Science and Technology (CPHST)  in Miami FL intends to award a firm fixed priced order for Binder chamber Model KBFP720UL-240V Constant climate chambers with ICH-compliant light source & water supply set.  All cost to include but not limit to: overhead, general and administrative, profit, insurance, and transportation.

The rationale for not openly soliciting this requirement is:

In accordance with Federal Acquisition Regulation (FAR) 13.106-1 for Brand Name Purchases

And

 In accordance with Federal Acquisition Regulation (FAR) 13.106-3(b)(3)(i) (i) when only one source is solicited and the acquisition does not exceed the simplified acquisition threshold

In accordance with FAR 19.502-2(a): each acquisition above the micro- purchase

threshold, but not over the simplified acquisition threshold, shall be set aside for small business.  In this case; Contracting Officer has determined a formal solicitation  for competition is not necessary because the OEM Binder Inc is a small business.  The additional administrative cost for  solicitation procedures were not deemed warranted and would only cause substantial duplication of cost to the Government that is not expected to be recovered through competition, and unacceptable delays in fulfilling the agency’s requirements.

The main characteristic for which USDA-APHIS-PPQ-CPHST Miami Lab selected Binder is its ability to maintain both temperature and humidity stable for long periods of time.  The lab has other incubators such as Percival and Panasonic.  Binder performs the best for cold treatment.

  1. Performance Requirements

The Program requires the incubator/chamber to keep the temperature consistently stable for extended period for the purpose of phytosanitary cold treatment development. We used Binder chamber before for this purpose and they met our requirement well. Following are the specifications for the constant climate chamber.

This Notice of Intent is not a request for competitive proposals.  No solicitation documents are available and telephone requests will not be honored.  However, if a firm believes it can meet the requirements it must furnish product literature sufficient for USDA Program to make a determination of suitability of product in accordance with specifications.   to the Contracting Officer by 4:00pm. (MST)  on the closing date of this notice.   Supporting evidence must be furnished in sufficient specifications and  detail to demonstrate the ability to comply with the above requirement.  The North American Industry Classification System (NAICS) code for this acquisition is 334516 Analytical Laboratory Instrument Manufacturing, and the size standard is 1,000 Employees
