Description
Under Statutory Authority 41 U.S.C. 1901, the United States Department of Agriculture, Farm Production and Conservation – Business Center intends to award a sole source commercial service firm-fixed price contract to Bozic LLC for Dairy Margin Coverage (DMC) that provides risk management for participating dairy operations. The DMC Cairy Decision Tool is an online resource used by participating dairy operations for margin selection in annual DMC enrollment and provides information regarding milk price and feed cost trends.
This website has been in use since 2021 and Bozic LLC has been the original developer and sole provider of maintenance and support services since its implementation. The DMC Decision Tool was created as a resource for dairy operations considering participation in the DMC risk management program. Dairy economists from land grant universities developed the tool because of their expertise in the concept of the dairy margin (the difference between the monthly National All-Milk price and feed cost formula including corn, soybean meal and sand premium alfalfa hay).
Bozic LLC is uniquely qualified to provide maintenance services for The DMC Decision Tool website due to the following reasons:
- Bozic LLC has in-depth understanding of the website’s architecture, customizations, and operational nuances developed over the years.
- The technical staff at Bozic LLC has specialized skills and training that are critical for effective maintenance and support, which cannot be replicated by other vendors without significant time and cost investment.
- Engaging a different vendor for the DMC Decision Tool would pose significant risks
- Operational disruptions, transitioning maintenance services to a new vendor could lead to operational disruptions and potential downtime, impacting critical business functions.
- Quality and reliability would cause a risk of degraded quality and reliability to support service delivers due to the new vendor’s learning curve.
- Transitions costs, switching to a new vendor would incur substantial transitions costs, including training, knowledge transfer, and potential modifications to the DMC Decision Tool to accommodate the new maintenance provider.
This acquisition is conducted under the authority of 41 U.S.C. 1901 Simplified Acquisition procedures as implemented in FAR 13.106-3(B)(3)(i), only one responsible source and no other supplies or services will satisfy agency requirements. This will be a firm fixed price Blanket Purchase Agreement for 60 months of performance. The NAICS Code is 518210 Data Processing, Hosting and Related Services, $35,000,00.00 in annual revenue.
This notice of intent is NOT a request for proposals or quotations. Requests for copies of a solicitation is response to this notification will not be honored or acknowledged. A determination by the Government not to compete this proposed action based upon responses to this notice is solely within the discretion of the Government.
Information received will be considered solely for the purpose of determining whether conduction a competitive procurement is in the best interest of the Government. Interested parties may identify their and capability by responding to this notice via email to the Contracting Officer by 2:30 PM (EST) 8/14/2024.

All information submitted should support the offerors capability to provide the product required and shall be furnished at no cost or obligation to the Government. The Government reserves the right to cancel to Sole Source Award. If no responses are received, the Contracting Officer will proceed with the sole source to Bozic LLC.
