THIS IS A NOTICE OF INTENT TO AWARD A SOLE SOURCE SUPPLY CONTRACT AND
IS NOT A REQUEST FOR COMPETITIVE QUOTES. The Defense Health Agency Contracting Activity (DHACA), Healthcare Contracting Division – West (HCD-W), intends to award a firm fixed price five (5) year Blanket Purchase Agreement (BPA) to procure various radiopharmaceuticals from RLS (USA), Inc. for use in the Nuclear Medicine Division at Naval Medical Center San Diego (NMCSD) in accordance with the Federal Acquisition Regulation (FAR) 13.501(a) Sole Source acquisitions and FAR 13.1061(b)(1)(i), only one source being available to meet the Government’s needs, to:

The North American Industry Classification System (NAICS) code for this requirement is 325412 - PHARMACEUTICAL PREPARATION MANUFACTURING - In-Vitro Diagnostic Substance Manufacturing; the business size standard is 1300 (in employees). The Product Service Code (PSC) is 6505 - DRUGS AND BIOLOGICALS.
The objective of this sole source award is to procure 31 different radiopharmaceuticals that are routinely used as well as four supplemental “kits” or medications and two STAT delivery charges for after-hours emergency deliveries from RLS (USA), Inc. Nuclear Medicine is a modality in Radiology that performs diagnostic imaging as well as certain treatments for patients. Radiopharmaceuticals are medications that are also radioactive and are used to perform these procedures. They are administered either intravenously or orally and the patients are then imaged in a gamma camera according to protocol. Due to the radioactive nature of these medications, strict adherence to Dept of Transportation regulations must be considered. The half-life of the radioactive component for radiopharmaceuticals is extremely short and therefore they have a shelf-life of six hours on average. Due to the short shelf-life, radiopharmaceuticals are delivered daily to Nuclear Medicine and are administered or discarded by the end of the day.

RLS (USA), Inc. is the only source that can meet the Government’s minimum requirements to provide the requested supplies and reagents mentioned above at NMCSD.
This notice of intent is not a request for competitive proposals, and no solicitation document exists for this requirement. Sources interested in responding to this notice are required to submit a capability statement that includes management and technical data and cost information, in sufficient detail and with convincing evidence that clearly demonstrates the capability to provide the required customized implant for NMCSD. Capability statements shall not exceed six (8.5 x 11 inch) pages using a font size no smaller than 10-point. All capability statements received by the due date of this notice will be considered by the Government. A request for documentation or additional information or submissions that only ask questions will not be considered as an affirmative response. A determination by the Government not to compete based on responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement or to proceed with a sole source purchase order.
