NOTICE OF INTENT TO SOLE SOURCE – Equipment: One (1) Three-Phase Gas-Insulated Generator-Step-Up (GSU) 120,000 kVA Transformer

This notice is being published in accordance with DFARS PGI 206-302-1, which states, “when utilizing the authority at FAR 6.302-1, the contracting officer shall post a request for information or a sources sought notice, and shall include the results of this inquiry in the justification required by FAR 6.303.” The statutory authority for this notice of intent to sole source brand name requirement is 10 U.S.C. 3204(a)(5) as implemented by FAR 6.302-1(c)(1) – Only one Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.

The U.S. Army Corps of Engineers, Little Rock District (SWL), has a requirement for a Firm-Fixed Price (FFP) construction contract at Bull Shoals Powerhouse to remove and replace the “T3” bank of transformers with one three-phase gas-insulated GSU 120,000 kVA transformer. FAR Part 6.302-1(c)(1) is not intended to be used for the entire contract; rather, only the item listed below unless the results of this notice indicate otherwise.

Three-phase gas-insulated GSU 120,000 kVA transformer – Toshiba

The Government will not purchase transformer from Toshiba directly, but it will be a brand name specification requirement in the Design Bid Build (DBB) solicitation that will lead to the FFP construction contract.

*This is not a solicitation for competitive proposals; however, if any interested party believes that they can meet the above requirement, they may submit a capability statement to the point of contact listed in this Special Notice. All information furnished must be in writing and must contain sufficient detail to allow SWL to be able to determine if the interested party provide the requirement described herein.

All responsible sources may submit a capability statement which shall be considered by the agency. The submission must be received no later than 12:00 PM CDT on April 17, 2024.
