Notice to Intend Sole Source Expedited Repair and Maintenance Services to the AB Sciex, LLC’s Liquid Chromatography (LC) Tandem Mass Spectrometry (MS)

THIS IS A NOTICE OF INTENT TO AWARD A SOLE-SOURCE CONTRACT AND IS NOT A REQUEST FOR COMPETITIVE PROPOSALS.

The United States Army Medical Research Acquisition Activity (USAMRAA) in support of the United States Research Institute of Chemical Defense (USAMRICD) intends to negotiate on a sole source basis, IAW FAR 13.501(a)(1)(ii), with AB Sciex, LLC, 1201 Radio Road, Redwood City, CA 94065, as the only responsible source that can provide Expedited Repair and Maintenance Services (guaranteed 2 business day response time) to the AB Sciex, LLC’s Liquid Chromatography (LC) Tandem Mass Spectrometry (MS) instruments (to include Liquid Chromatography systems and Uninterpretable Power Systems), including Preventative Maintenance Services and Software upgrades to all covered SCIEX software. This acquisition is planned to be solicited under FAR 13.5 - Simplified Procedures for Certain Commercial Products and Commercial Services. Provisions and clauses in effect through Federal Acquisition Circular 2005-83 are incorporated.

USAMRICD has a requirement for a firm-fixed-price requirement for a non-personal services contract to provide the above mentioned services. AB Sciex, LLC. is the original equipment manufacturer (OEM) and sole manufacturer of the AB Sciex, LLC. LS and MS instrument systems (comprising of AB Sciex, LLC. and other third-party subcomponents and subsystems) located at USAMRICD. These systems were purchased from AB Sciex, LLC.

Market research was conducted, and only one (1) potential source was identified: AB Sciex, LLC, 1201 Radio Road, Redwood City, CA 94065.

The sole source that can provide all required Expedited Repair and Maintenance Services is AB Sciex, LLC. and the sole way the required lead times can be met is through a direct contract with AB Sciex, LLC. AB Sciex, LLC. Field Service Engineers are manufacturer-trained experts that are uniquely qualified to service and repair the LC and MS systems. The Mass Spectrometer and the software used to run the LC and MS systems are proprietary to AB Sciex LLC. Equipment covered under AB Sciex, LLC. service contracts are serviced within twenty-four (24) hours of the initial request, whether the request is an unscheduled emergency, maintenance, or a repair call.

AB Sciex, LLC. does not support third party repair and maintenance of their systems.

The intended procurement will be classified under North American Industry Classification System (NAICS) 811210 – Electronic and Precision Equipment Repair and Maintenance with a Small Business Size Standard of $30,000,000.

This announcement fulfills the synopsis requirements under FAR 5.102(a)(6) and 5.203(a). USAMRAA intends to publish a solicitation no sooner than 15 days after publishing this synopsis. This notice of intent is not a request for competitive proposals and no solicitation document will be posted for this requirement.  

Parties interested in responding to this notice shall submit technical data, including cost, sufficient to determine capability in providing the required services.  All submissions received by the date and time provided in this notice (and determined to be responsive) will be considered by the Government.

Submissions that request documentation, request additional information or that solely ask questions will be determined to not be an affirmative response. Responses determined to be not an affirmative response are not valid and will not be evaluated further.

A determination by the Government not to compete based on responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. This announcement fulfills the synopsis requirements under FAR 5.102(a)(6) and 5.203(a).

Based on the above information, the only source that can meet the Government’s requirement for is AB Sciex, LLC, 1201 Radio Road, Redwood City, CA 94065.
