Description
The Naval Air Systems Command (NAVAIR), NAS Patuxent River, MD, intends to negotiate and award a delivery order under Basic Ordering Agreement (BOA) N00019-23-G-0002 to Sikorsky, A Lockheed Martin Company, 6900 Main St. Stratford, CT 06615-9129 for the continued test and correction of deficiencies on the Main Gearbox Gear Tooth Bending Fatigue, Intermediate Gearbox Gear Tooth Bending Fatigue, Fuselage Fatigue Test Article (fFTA), Empennage Fatigue Test Article (eFTA) Reinforcement, Landing Gear Blowdown Bottle Safe for Flight and Wheel Brakes for the United States Marine Corps (USMC) CH-53K® Helicopter.
The proposed contract action(s) identified above are those for which the Government intends to solicit and negotiate with only one source under the authority of 10 U.S.C.3204(a)(1) and FAR 6.302-1, “Only One Responsible Source and No Other Type of Supplies or Services will Satisfy Agency Requirements.” Sikorsky is the sole designer, developer, and producer of the CH-53K aircraft and the only known contractor with the requisite knowledge, experience, and technical data able to provide the required level of supplies and services in support of this requirement. The Government does not possess adequate license rights to the required technical data package necessary to support a competitive procurement to fulfill the requirement herein. As a result, only Sikorsky has the unrestricted totality of technical data, unique engineering support experience, and detailed knowledge of the CH-53K to meet the Government’s requirements.
THIS NOTICE OF INTENT IS NOT A REQUEST FOR COMPETITIVE PROPOSALS. Interested parties, however, may identify their interest and capability by responding to the requirement. The Government will consider all information received prior to the closing date of this synopsis. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement. A determination by the Government not to compete the proposed contract modification based upon responses to this notice is solely within the discretion of the Government.
