Description
The Commodity Futures Trading Commission (CFTC) intends to award a purchase order to Employment Learning Innovations, Inc., on a sole source basis, for “Inclusion Now” training sessions. The period of performance is a base of one (1) year. The Government intends to procure this requirement under USC 41 §3304 (a)(1) and FAR 13.106-1(b)(1)(i) which states "the circumstances of the contract action deem only one source reasonably available." In accordance with executive order on Diversity, Equity, Inclusion and Accessibility in the Federal Workforce, CFTC requires diversity and inclusion training for leadership. Specifically, Inclusion Now provides a behavior-based training program that leverages cultural backgrounds, personal characteristics and unique experiences to allow participants understand the benefits from an inclusive workplace to make better, more informed decisions. The training also includes topics on unconscious bias, bystander intervention, allyship and using inclusion conversations. There is no known alternative source that provides the attorney led training sessions, addresses all the related topics (such as unconscious bias, role play of inclusive conversations, self-analysis tools, action plans and evaluation from each of the sessions) and tailors the material to include agency specific scenarios required by CFTC which is available through the identified product. This training will assist CFTC in meeting mission goals to have resources and further educate, strengthen and advance diversity, equity, inclusion and accessibility across the agency. The identified vendor is the sole provider of these items. Therefore, this vendor is the only responsible source identified as reasonably available that will satisfy the agency requirements.
THIS NOTICE IS NOT A REQUEST FOR COMPETITIVE PROPOSALS and a solicitation will not be issued. However, the Government will consider responses from all responsible sources received by the date and time identified above. Written responses must include sufficient information to establish capability to fulfill the requirement. Oral communications are not acceptable in response to this notice. Any responses received will only be considered for the purposes of determining whether to conduct a competitive procurement in lieu of the sole source described in this notice, and such determination shall be made at the sole discretion of the CFTC.
