Description

The Commodity Futures Trading Commission (CFTC) intends to award a purchase order to the Energy Intelligence Group, Inc. on a sole source basis for access to their subscription that provides analysis, data access, and service to Oil Daily, Natural Gas Week, and World Gas Intelligence publications. The purchase order will be for a base period of one year with two, one-year options to extend the period of performance. The Energy Intelligence Group, Inc. purchase order will provide online access to analysis and information that allows the Agency to stay current with the oil, natural gas and world gas commodities to successfully perform oversight and monitor the markets. Although the CFTC receives energy information from various providers, Energy Intelligence Group, Inc. provides unique analysis through their subscription and data access services. The CFTC does not know of any alternatives to obtaining the analysis unique to the Energy Intelligence Group, Inc. subscription. 

This procurement action is being conducted under FAR 13.106-1(b)(1)(i) “Contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization).”  For the subject requirement the government intends to award on a sole source basis to Energy Intelligence Group, as the required services are available from only one responsible source and there are no other known services that will satisfy CFTC’s needs. [41 U.S.C § 3304(a)(1)]

This notice does not constitute a solicitation for offers and, as such, no solicitation is available. However, the Government will consider responses from all responsible sources received by the response date and time identified in this synopsis. Written responses must include sufficient information to establish capability to fulfill the requirement. Address all responses to Jerald Neveleff at jneveleff@cftc.gov. Any responses received will only be considered for the purpose of determining whether to conduct a competitive procurement in lieu of the sole source contract described in this notice, and such determination shall be made at the sole discretion of CFTC.
