Pen-Link Software Licenses and Support

The Federal Bureau of Investigation (FBI) intends to award a sole source purchase order to Pen-Link, LTD, 5936 Vandervoort Drive, Lincoln, NE 68516 for Pen-Link software and maintenance. Software licenses and maintenance are needed in support of the Office of Chief Information Officer and the Enterprise License Agreement Management Unit. This solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2022-05, the North American Industry Classification System (NAICS) is 511210 with a business size standard of 41.5 million dollars. A quote is being requested under solicitation no. DJF-22-4750-PR-0000107. This will be a fixed price contract for a 12-months base period with two 12-month option years. Based on FBI market research, it has been determined that Pen-Link, LTD is the only source to meet the FBI requirement and no other supplies or services will satisfy the agency requirements. Pen-Link does not have any authorized resellers capable of providing the required maintenance and service. The proposed contract action is for the renewal of maintenance and service for which the Government intends to solicit and negotiate with only one source under the authority of TLE 41,usc (a)(1). This notice is not a request for competitive proposals. Interested parties may identify their interest and capability to respond by submitting a proposal to include technical qualifications and experience/pricing and any other information to Christina Nortey, Contracting Office, and address listed above. The following clauses and provisions are incorporated by reference and apply to the acquisition: FAR 52.212-1, Instructions to offeror-Commercial Items (NOV 2021): FAR clause 52.212-2, Evaluation Commercial Item (NOV 2021), FAR clause 52.212-4 Contract Terms and Conditions Items (NOV 2021); FAR 52.212-5 clause, Contract Terms and Conditions Required to Implement Statutes or Executive Orders Commercial Items (JAN 2022). Each offeror shall include a complete copy of the clause 52.212-3 Offeror Representations and Certifications - Commercial Item (NOV 2021). A determination by the Government not to compete this proposed required is based upon responses to this notice and is solely within the discretion of the Government.
