The U.S. Army Corps of Engineers (USACE), Portland District (NWP) intends to negotiate/award a sole-source contract with Advanced Telemetry Systems, Inc. (ATS), to provide Juvenile Salmonid Acoustic Telemetry System (JSATS) Tags for a fish passage and survival at USACE Willamette Valley Project (WVP) sites during fall 2022. The fish passage and survival study will be conducted by researchers under a separate contract.
ATS will supply 2,000 individual Juvenile Salmonid Acoustic Telemetry System (JSATS) transmitters (tags) Model SS400 Series Gen IV acoustic transmitters, (62) SR3017 shore-based receivers and (8) SR3001 submersible receivers.
Government has determined this contract to be of critical importance to the fish operations in the WVP, and that feasible substitutes are not available.
REASON FOR SOLE SOURCE ACQUISITION:
The statutory authority for this non-competitive acquisition is 10 U.S.C. § 2304(c)(1), as implemented by FAR 6.302-1 and DFARS 206.302-1, there is only one (1) responsible source and no other type of supplies or services will satisfy agency requirements.
The proposed sole source contractor is Advanced Telemetry Systems, Inc. Compatibility with existing equipment is the characteristic that makes this firm the only one capable of supplying the required item.
The Government owns the pending patent and frequency of the required JSATS tags. The Government made the specifications of the patented tag available to the public. USACE currently owns the activation and detection equipment for the patented JSATS tags for fish passage and survival studies. The tags will be used for the MMD fish passage and survival study and the required Model SS400 acoustic tags are built to the specifications of the patented tag and are compatible with existing equipment. ATS is the only vendor manufacturing these tags to specification.
A solicitation for this sole source action is currently not available. All responsible sources may submit a capability statement, proposal, or quotation, which shall be considered by the agency.

CAPABILITY STATEMENT SUBMISSION REQUIREMENTS

3. The Government will evaluate the capabilities of an interested party based on their submission of information detailing a minimum of two (2) years of experience producing JSATS tags that are 15.0 x 3.38 mm in size and weighs 216 mg and built to the specifications of the pending patent.
