Purchase of Spectrum Infusion Systems for the Cheyenne River, Eagle Butte IHS, Eagle Butte, SD

The Great Plains Area Indian Health Service hereby submits a notice of intent to award a sole source, firm fixed price order for a commercial available item to Baxter Healthcare Corporation, a large business. The period of performance will be from 01/28/2022 to December 31, 2022.  The Order is for the purchase of Spectrum IQ Infusion Pumps with accessories for the Eagle Butte IHS. Total estimated value is less than $250,000.00.

The sole source, urgent and compelling, contract action is based on an LSJ, waiver from purchasing on a competitive basis pursuant to FAR 8.405-6(a)(1)(i)(A); - an urgenty and compelling need exists and following the procedures would result in unacceptable delays.  Vendor holds proprietary rights to the equipment.  

Responses to the notice must demonstrate clear and convincing evidence that competition would be advantageous to the Government, would not be cost prohibitive, and would not hinder the mission objective of agency standardization, data center standarization, and network security. 

The determination to not compete this proposed contract actoin is solely within the discretion of the Government. Information received will normally be considered for purposes of determining whether to conduct a competitive procurement. The Government will not be responsible for any costs incurred by responding to this notice.
