NOTICE OF INTENT TO AWARD A SOLE SOURCE CONTRACT FOR CONSULTING SERVICES

ANNOUNCEMENT NUMBER: ACQ-23-0541

The Department of Labor (DOL), Office of the Senior Procurement Executive (OSPE), Office of Acquisition Services (OAS), hereby submits a notice of intent to award a sole-source award to Eastern Research Group, Inc. located at 110 Hartwell Avenue, Ste 1, Lexington, MA 02421-3134 to provide consulting services under the firm’s DOL BPA 1605DC-18-A-0014.  Competition is being restricted against multiple award BPA holders. The contractor shall provide technical, statistical, and editorial expertise to assist MSHA in developing, conducting, and/or refining the regulatory impact analysis (RIA), including the regulatory alternative analysis and regulatory flexibility analysis (RFA), technological and economic feasibility analysis, health effects analysis, quantitative risk assessment (QRA), and Paperwork Reduction Act (PRA) analyses for MSHA’s safety and health rulemakings which include respirable crystalline silica and other topics specified by MSHA.

The procurement will be issued under the authority of Federal Acquisition Regulation (FAR) FAR 8.405-6(a)(1)(B):  Only one source is capable of providing the supplies or services required at the level of quality required because the services are unique or highly specialized.  The North American Industry Classification System (NAICS) code is 541611.

Responses to this notice must demonstrate clear and convincing evidence that competition would be advantageous to the Government, would not be cost or time prohibitive, and would not delay the consulting services.

The determination not to compete this proposed contract action is solely within the discretion of the Government. Information received will normally be considered for the purposes of determining whether to conduct a competitive procurement. The Government will not be responsible for any costs incurred by responding to this notice.

This is NOT a request for quotes or proposals. A solicitation is not available.
