Description
The National Institute of Standards and Technology (NIST) intends to negotiate on a sole source basis, under the authority of FAR 13.106-1(b) (1), with: Diablo Analytical, Inc., 5141 Lone Tree WAY Antioch, California, 94531-8688.
The sole source justification is based on the following:
The Mass Spectrometry Data Center (MSDC) at the National Institute of Standards and Technology (NIST), Material Measurement Laboratory (MML), Biomolecular Measurement Division (BMD) is responsible for the development of the NIST/National Institutes of Health (NIH)/Environmental Protection Agency (EPA) Mass Spectral Library and Tandem Mass Spectral Library. To carry out this responsibility, the MSDC has a requirement to measure compounds by mass spectrometry or acquire spectra that have already been measured to evaluate for inclusion in the libraries.
This requirement is for the delivery of the Adams Essential Oils Library to NIST. NIST will conduct a detailed analysis of the data for possible inclusion in the 2023 release of the NIST/NIH/EPA Mass Spectral Library.
Dr. Robert Adams, author of Essential Oil Components by GC/MS, created an Essential Oils Library. He transferred the rights to the Essential Oils Library to Diablo Analytical, Inc before his death. This Essential Oils Library is the only one that meets NIST specifications and Diablo Analytical, Inc is the only company with the rights to sell it.
Given these facts, Diablo Analytical, Inc. is the only source reasonably available to fulfill the requirement. The resulting purchase order will be a Firm Fixed Price purchase order. The NAICS Code is 325199 - All Other Basic Organic Chemical Manufacturing with a size standard of 1250 employees.
No solicitation package will be issued. This notice of intent is not a request for competitive quotations; however, interested parties who regard themselves as capable of fulfilling these requirements are invited to submit responses to the Government for consideration. Responses received by 9:00 am EST August 17, 2022, will be considered by the Government. Responses must be submitted via email to the Government point of contacts listed below.
A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
