SUBJECT: Market Research Exemption for AP 36C250-23-AP-2749
TO: VA Heads of Contracting Activities, Regional Procurement Office Central
The specialized nature of prosthetic implant considers the agency's need to limit competition. Due to sole source selection as prescribed by the Veteran s prescribing clinician, no additional market research has been performed. In compliance with FAR 16.505(b)(2)(i)(B), only one awardee can provide the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized. Prosthetic implant components are specified by the clinical team to meet the unique and comprehensive needs of each Veteran with that is scheduled for the performed surgery. Pricing is determined to be fair and reasonable based on comparison to Medicare allowable rates less 10% discount.
