Description

Maritime Surveillance Associates (MSA) in Brunswick, ME was awarded a Cost Plus Fixed Fee (CPFF) Delivery Order (DO) N00019-22-F-2372 under Basic Ordering Agreement (BOA) N00019-20-G-0003 by Naval Air Systems Command (NAVAIR) for Global Reconstruction Analysis and Measurement System (GRAMS) Enhancements. The estimated period of performance for this order is 1 September 2022 through 31 August 2023.

This acquisition was conducted on a sole-source basis under statutory authority of Title 10, U.S.C. Section 2304(c)(1), as implemented by Federal Acquisition Regulation (FAR) 6.302-1, "Only one responsible source and no other supplies or services will satisfy agency requirements." A determination by the Government not to compete this effort is solely within the discretion of the Government. This effort is covered under the Class Justification and Approval (CJ&A) number 19-0542, 14 February 2020, attached.

It was determined that a CPFF contract action was the appropriate contract type pursuant to DFARS 235.006(b)(ii)(A).  The use of a fixed-price type contract would not provide an equitable and sensible allocation of program risk between the Government and the Contractor, and using a cost-plus-incentive fee is not practical. The exact nature and precise method of accomplishing the work is not sufficiently detailed to adequately predict costs on a fixed price basis.
