Description

This is a notice of intent to award a sole source contract and is not a request for quotes. The Department of Veterans Affairs East Orange VAMC intends to award a Firm Fixed Price Sole-Source Brand Name only action to: Name of Contractor: Marathon Medical Street Address: 3251 Lewiston Street, Suite 16 City, State, Zip: Aurora, CO, 80011 The Smiths Medical CADD Solis pumps are used for pain management in patients via the controlled infusion of local anesthetics via peripheral nerve or epidural catheter. Per hospital policy, a unique pump must be used for this application to prevent the accidental infusion of improper medications via a standard IV pump. In Accordance with Statutory Authority Permitting Other than Full and Open Competition: 41 USC §3304(a)(5), 38 U.S. Code § 8127(c), as implemented by FAR 6.302-5 (Authorized or Required by Statute).  COs may use the non-competitive (sole source) procedures authorized in VAAR 819.7008 (DEVIATION) or VAAR 819.7009 (DEVIATION) up to $5,000,000.  Check the specific VAAR clause used below: ( x ) 819.7008 Sole source awards to a certified service-disabled veteran-owned small business; or (  ) 819.7009 Sole source awards to a certified veteran-owned small business An additional requirement is full interoperability between these infusion pumps and the older CADD pumps which we currently use in the ambulatory setting, including a common set of single patient use disposablesThe Veterans Health Administration prohibits the use of gray market items in their Medical Centers. Gray market items are considered to be items outside of the original equipment manufacturer s intended distribution channels.
