Description

The US Department of Commerce (DOC), National Oceanic and Atmospheric Administration (NOAA), Eastern Region Acquisition Division, Simplified Acquisition Branch intends to negotiate on a sole source basis with Percival Scientific, Inc., using the procedures in FAR Part 13, to provide Seven (7) Percival Scientific model I-36 LLVL incubators to maintain HAB cultures critical for achieving agency forecasting goals.

The Beaufort Lab maintenance personnel are proficient at maintaining and repairing refrigeration and control systems in units made by Percival Scientific, and having trained professionals on-site minimizes costs for outside labor and maintenance. Using a different incubator would be detrimental to the lab environment due to additional training, maintenance, and continuity of operations. The required incubators must be compatible in all aspects (form, fit, and function) with existing. Using the same original equipment manufacturers incubators is the only way to meet the requirement.

Market research indicates that Percival Scientific is the only current vendor able to meet the agency’s needs for this requirement. Percival Scientific has no authorized resellers/partners for their incubators.

The statutory authority for other than full and open competition is FAR 13.106-1(b)(1)(i), Only one responsible source.

The North American Industry Classification Code (NAICS) for this acquisition is 334516, Analytical Laboratory Instrument Manufacturing, with a business size standard of 1,000 employees.

This is not a solicitation for competitive quotes, nor will one be posted on the Contract Opportunities website.

The determination by the Government not to compete this proposed requirement based upon responses to this notice is solely within the discretion of the Government.  However, if any interested party believes that it is capable of meeting the requirements, all responsible sources may submit a Capability Statement in accordance with this notice, which may be considered by the agency if received on or before 11:00 AM EST on December 31, 2024.  The Capability Statement must contain material in sufficient detail to allow NOAA to determine if the party can meet all of the requirements.
