Description

This is a notice of intent, not a request for a quotation. A solicitation document will not be issued, and quotations will not be requested.

Purpose
The National Institute of Standards and Technology (NIST) intends to negotiate a firm-fixed priced purchase order on a sole source basis with Keysight Technologies, located at 1900 Garden Of The Gods Road, Colorado Springs, CO 80907-3423. The Purchase Order will specifically procure contractor services to provide an extended warranty on an existing, government-owned Infiniium UXR Real-Time Channel Sounding Oscilloscope, which was manufactured by Keysight Technologies, Inc. The period of performance will be effective from October 20, 2024, through October 19, 2025.

Authority
This acquisition is being conducted under the authority of FAR Subpart 13.106(b)(1) allowing the Contracting Officer (CO) to solicit from one source. The North American Industry Classification System (NAICS) code for this acquisition is 811210 –Electronic and Precision Equipment Repair and Maintenance with small business size standard of $34,000,000.

Description
The Radio Access and Propagation Metrology Group in the Wireless Networks Division at CTL supports the Channel Measurement and Modeling project and performs dynamic real-time radio frequency propagation measurements to support industry and standards organizations. CTL currently owns and operates a Keysight UXR series oscilloscope, manufactured by Keysight Technologies, for the next-generation 140 GHz channel sounder. NIST seeks to obtain an extended warranty on the current OEM warranty for the Keysight Infiniium UXR Real-Time Oscilloscope, 40 GHz, 256 GSa/s, 4Ch (serial number: UXR0404A/SG62120101). The existing  oscilloscope is critical for the application of, and performance for, the channel sounder. The current warranty on the Keysight Infiniium UXR Real-Time Oscilloscope expires on 10/19/2024.

The Contractor shall provide warranty service by an authorized service technician. The extension of the current OEM Warranty for the existing Infiniium UXR Real-Time Oscilloscope, 40 GHz, 256 GSa/s, 4Ch (with model and serial number UXR0404A/SG62120101) shall include a “Return to Keysight Extended Warranty” per the OEM’s commercial warranty.

The contractor shall provide an extended 1-year warranty for the UXR oscilloscope, as well as  repair coverage that ensures 10-day turnaround for repairs and. The warranty shall be provided in accordance with the OEM’s standard commercial warranty. The warranty shall include  shipping provided by the manufacturer and 10-day repair turnaround time on any necessary repairs that fall within the terms of the warranty.

Sole Source Determination
The sole source determination is based on the following:

Keysight Technology, Inc. is the exclusive provider of Keysight's Proprietary software updates and for proprietary factory recommended upgrades, including software updates. In addition, Keysight Technologies, Inc. is the sole source for factory-recommended replacement parts and is the sole provider of training to OEM authorized service representatives and OEM authorized escalation services. No other service providers are authorized to provide extended warranty coverage for this requirement. The warranty services required by NIST are available from only one responsible source, Keysight Technologies, Inc and no other type of supplies or services will satisfy agency requirements. For purposes of continuity of science, Keysight Technologies, Inc., is the only source that can fully achieve this requirement and the required services must be purchased directly through Keysight Technologies, Inc. No other sources exist that can achieve this requirement.

Interested parties that believe they could satisfy the requirements listed above for NIST may clearly and unambiguously identify their capability to do so in writing by or before the response date for this notice. This notice of intent is NOT a solicitation.
