THIS IS A NOTICE OF INTENT TO AWARD A SOLE-SOURCE CONTRACT – THIS IS NOT A REQUEST FOR COMPETITIVE PROPOSALS

The U.S. Department of Agriculture, Forest Service (USDA FS), Procurement & Property Services (PPS), Incident Procurement Organization (IPO) intends to award a sole source Indefinite-Delivery, Indefinite-Quantity contract to Fortress Fire Retardant Systems (Fortress) for a limited supply of Fortress fully qualified aerial Long-Term Fire Retardant (LTFR) products and ancillary product support to the USDA FS at various Airtanker base (ATB) locations, for the purpose of performing an Integrated Operation Field Evaluation. Award will be via modification to existing contract 1202SC21T4001 for Operational Field Evaluations. The USDA FS is continually reviewing, testing and sourcing new LTFR products and suppliers to increase capable sources of supply, to continue to meet greater wildland fire demands and continue to exceed changing environmental regulations. The LTFR aerial product required and supplied must be Fortress fully qualified aerial LTFR products on the Qualified Products List (QPL) in accordance with USDA, USFS Specification 5100-304d (or latest version) - Long Term Retardant, Wildland Firefighting with amendments.

The statutory authority permitting other than full and open competition is 41 U.S.C. 3304(a)(1), (FAR 6.302-1) Only one responsible source and no other suppliers or services will satisfy the agency requirements.

This notice of intent is NOT a request for proposals or quotes. Within 5 calendar days of this posting, all interested and responsible sources, meeting the stated requirement above, including providing Fortress fully qualified aerial LTFR products, may contact the Contracting Officer (via email only) in writing. All responsible sources may submit a capability statement, proposal or quotation, which shall be considered by the agency. If no written responses are received within 5 calendar days of the publication of this notice, the modification to the contract will be awarded without further notice and a redacted copy of the justification will be posted within 14 days of the contract modification date. A determination by the Government not to open the requirement to competition based upon the responses to this notice is solely within the discretion of the Government.
